Exceptions for Special Types of Refunds

If you file a claim for one of the following, the dates and limits discussed earlier may not apply:

  1. A bad debt
  2. A worthless security
  3. Foreign tax paid or accrued
  4. Net operating loss carryback
  5. Carryback of certain business tax credits
  6. A claim based on an agreement with the IRS extending the period for assessment of tax

  7. An injured spouse claim. Instead, file only Form 8379.

When is the deadline for filing Form 1040X for bad debt?

A Form 1040X based on a bad debt or worthless security generally must be filed within 7 years after the due date of the return for the tax year in which the debt or security became worthless.

 
When is the deadline for filing form 1040X for net operating loss carryback?

A Form 1040X based on a net operating loss carryback or a general business credit carryback generally must be filed within 3 years after the due date of the return.

 

Processing Claims for Refunds

Claims are usually processed shortly after they are filed. Your claim may be accepted as filed, disallowed, or subject to examination. If your claim is disallowed, you will receive an explanation of why it was disallowed.
